TERMS & CONDITIONS:
TERMS OF ENGAGEMENT:
Please ensure that the client has read the terms & conditions in all cases. This agreement between you ‘ the client’ and us ‘CORKSCREW EVENTS’ will be governed by English law and any disputes will be dealt with through the English legal system and H.M.Courts. This contract comes into force once the price has been agreed. It is the responsibility of the client to ensure that all members of their company are aware of the terms and conditions. CORKSCREW EVENTS is a limited company registered in England. The company number is 5471721.
CORKSCREW EVENTS staff will not be able to start work on a proposal for our clients until the terms & conditions including the terms of engagement have been signed.
The Terms of Engagement within this contract is for the sole purpose of CORKSCREW EVENTS to carry out the initial work and get the commitment from the client before any time or work has been spent on putting together detailed quotes and packages. This will establish the client’s serious intent in using CORKSCREW EVENTS as the sole provider for the work prepared and presented in the future. The client will NOT BE INVOICED until a final quote has been agreed by both CORKSCREW EVENTS and the client. Once the terms of engagement have been signed, any proposal presented to the client is for the sole purpose of the client’s event and must not be communicated to any other Events/ Promotions Company, Venue or third party.
MAKING A BOOKING:
To make a booking the client and all participants must be aged 18 years or over unless stated on the event details. Bookings can be made by fax, email or in writing. We cannot accept any liability for incorrect bookings. It is the responsibility of the client to ascertain the date and start time of any event or activity. The acceptance of a booking by CORKSCREW EVENTS implies recognition of the terms and conditions by the client. Separate terms and conditions as outlined below cover each element of the client’s event or activity, however when the client books overnight accommodation with an event or activity, third party accommodation conditions apply.
Bookings are valid after the appropriate deposit has been paid and the booking has been confirmed in writing (including any advice by e-mail) by CORKSCREW EVENTS to the lead the client. The event or activity that the client has booked is as described in our final confirmation letter issued once all monies have been collected. The lead person who submits an enquiry certifies that he or she is authorised to agree the booking terms and conditions on behalf of all persons expected to attend the event, including those substituted or added at a later date. The point of contact must be 18 years or over. A minimum deposit of 25% of the total amount per person must accompany bookings, which is non-refundable. The balance must be paid at least six weeks prior to the commencement of the event or activity. If the booking is within six weeks of the event or activity, payment in full is required at the time of booking.
ACCOMODATION INCLUDED IN AN EVENT OR ACTIVITY PACKAGE:
When the client purchases an event or activity package with accommodation from CORKSCREW EVENTS, bookings are subject to third party terms & conditions. The following additional terms apply to the client purchase of accommodation with an event or activity package. When a booking has been accepted by us, we will issue the client with a receipt confirming the payment for the event package has been received. A contract will exist between the client and the accommodation. Once the accommodation has issued a confirmation invoice to CORKSCREW EVENTS, and all other arrangements offered by CORKSCREW EVENTS are provided under a separate contract, the charge will be invoiced to the client. Payment for the client accommodation is required six weeks before arrival, or if the booking is within six weeks of arrival then payment in full is required at the time of booking.
PAYMENT TERMS:
A contract is made between the client and CORKSCREW EVENTS when the client confirms the booking verbally or in writing (including any advice by e-mail). We will then send the client an invoice as receipt of payment and the client should check this to confirm that the correct information is detailed. The client must agree to pay CORKSCREW EVENTS a minimum deposit of 25% of the total amount per person to secure a booking and the balance of the total cost in accordance with theses terms & conditions. If the client fails to pay CORKSCREW EVENTS by the due date the clients event or activity will be cancelled and the cancellation charges detailed in these terms and conditions will apply.
MAKING A PAYMENT:
On receipt of the clients deposit or full payment, an invoice will be forwarded to the client within 7-14 days. This confirmation will detail the amount received and the amount due (if any) to be paid and the date that the final payment becomes due. For all events, full payment is to be received no later than six weeks before the commencement of the event. In certain circumstances the client booking may become void and cancellation charges may become payable (see below).
To make payments to CORKSCREW EVENTS the client can BACS payment or make cheques payable to ‘CORKSCREW EVENTS.’ Cheques can be posted to: CORKSCREW EVENTS, Branston Court, Branston Street, Birmingham, B18 6BA.
CANCELLATIONS:
If the client wishes to cancel any part of the booking after CORKSCREW EVENTS have accepted it, the client should advise CORKSCREW EVENTS immediately by telephone. CORKSCREW EVENTS also require at least 60 days written notice of cancellation before the event is due to commence. If the client wished to cancel the booking CORKSCREW EVENTS will not refund any deposits that the client has made. The client must also agree to pay cancellation charges which will reflect CORKSCREW EVENTS’ estimated loss as a result of dealing with the client booking to the point of cancellation and any other losses that we may have to pay to third parties. CORKSCREW EVENTS shall be entitled to retain all payments already made and to recover, if not already paid, the balance of the total cost as follows:
42-60 days notice 25% of the charge
29-41 days notice 50% of the charge
Less than 28 days notice 100% of the charge
Should the client’s company numbers decrease and CORKSCREW EVENTS are advised of the amount no later than six weeks prior to the client event date, CORKSCREW EVENTS will, where possible, not make a charge for this reduction in company size. However, under these circumstances deposits will not be refunded for those members not attending the event. We can change or cancel the client’s event in the following circumstances: war, threat of war, civil unrest, terrorist threat or activity, industrial disputes, natural or man made disasters, fire, flood, closure, severe weather conditions and events beyond the control of CORKSCREW EVENTS.
N.B. Certain accommodation bookings may result in 100% cancellation charges irrespective of the date of cancellation.
AMENDMENTS:
All alterations are to be made directly with CORKSCREW EVENTS. If the client wish to make any alterations to the booking after it has been confirmed, CORKSCREW EVENTS may attach an administration charge to the client’s final payment. However, we will endeavour to accommodate any reasonable request by the client for changes to the client planned event. CORKSCREW EVENTS are firstly required to confirm availability with suppliers and advise the client if this is possible, and whether there is any additional price that may be outstanding. CORKSCREW EVENTS reserve the right to apply cancellation charges to any individual element of the package as described above. CORKSCREW EVENTS cannot make any guarantees as third party members may not be so lenient. The client may not change the booking to any special offers that may become available before the date of the event. CORKSCREW EVENTS can change or cancel the event in the following circumstances: war, threat of war, civil unrest, terrorist threat or activity, industrial disputes, natural or man made disasters, fire, flood, closure, severe weather conditions and events beyond the control of CORKSCREW EVENTS. Many outdoor activities and events are dependent upon weather conditions to ensure the safety of all participants. Where any event has to be cancelled due to poor weather, CORKSCREW EVENTS will aim to ensure the client is advised in advance. If this is not possible the client may be advised upon arrival. In either case CORKSCREW EVENTS will re-schedule the activity or event for another date, and no refund will be payable. In the unlikely event that circumstances beyond the control of CORKSCREW EVENTS require cancellation of the event or activity, CORKSCREW EVENTS reserve the right to cancel any bookings at any time and will only be liable to refund monies already paid by the client. In the unlikely event that the supplier of the event or activity withdraws it from our programme CORKSCREW EVENTS reserve the right to substitute another similar event or activity. As with all events and activities of a similar nature to those supplied by CORKSCREW EVENTS, occasionally due to circumstances beyond the control of CORKSCREW EVENTS or the supplier, the event may be cancelled at short notice due to mechanical failure of equipment. Where an event is cancelled in such circumstances, the supplier or CORKSCREW EVENTS will do their best to offer an alternative activity or event of similar fiscal value. If the activity or event is declined by the client then CORKSCREW EVENTS will refund the client monies equivalent to the part value of the activity or event with respect to the cost of entire package. CORKSCREW EVENTS will not be liable for any additional monies other than the part value of activity or event within a package when a cancellation occurs in such circumstances.
INSURANCE & DISCLAIMERS:
CORKSCREW EVENTS endeavour to work with reliable and trustworthy third party organisations that manage and supervise their activities to the highest safety standards. CORKSCREW EVENTS confirm to the best of our knowledge that all third parties hold relevant safety and insurance policies. However, some third party organisations may require participants to sign a disclaimer before taking part in an activity. Participation in any activity is at the risk of the participators and adequate insurance cover must be obtained by all company members. Companies using third party facilities automatically agree to be bound by the terms and conditions of CORKSCREW EVENTS and the third party organisation. CORKSCREW EVENTS recommend that a suitable insurance policy is obtained for the client event before final payment is made and that all participants are fully and adequately insured. All persons attending an event organised by CORKSCREW EVENTS are responsible for organising their own insurance covering the risk of participation in the event or activity.
HEALTH & SAFETY:
Many events and activities require a good level of fitness strength and endurance and it is the responsibility of the client to ensure that all participants have the appropriate level. Many events are not recommended for those with any disability, illness or infirmity. All participants should check with a doctor that they are sufficiently fit and healthy to participate in the event or activity. If any participants are disabled or less mobile CORKSCREW EVENTS will be pleased to help the client to select particular events or activities which are suitable to their requirements. If any participants suffer from any medical problem, the client should seek medical advice before confirmation of the booking is made. The rules and regulations of the third party venues must be adhered to by all members of the company. Certain sports, activities or events may be subject to height, weight and health restrictions. The client must inform CORKSCREW EVENTS of any condition that may have an effect on the booking. Companies using third party facilities automatically agree to be bound by the terms and conditions of CORKSCREW EVENTS and the third party organisation. Some activities are by their nature dangerous. Those who have booked to participate in this type of activity assume the risks involved and CORKSCREW EVENTS cannot be responsible for claims for injury or loss, unless caused by the negligence of CORKSCREW EVENTS. Hence why CORKSCREW EVENTS ask all participants to be fully and adequately insured and only use the most reputable suppliers, who comply with all standards and regulations and who themselves have proper insurance.
CONDUCT:
It is the right of the third party activity organisers to refuse entry to any member of the company due to poor conduct. This can include drunkenness, abusive language or threatening behaviour. If the client’s behaviour or that of any company member is likely in the opinion of CORKSCREW EVENTS, or that of the third party organisers, to cause distress, damage, danger or annoyance to any other member of the public, CORKSCREW EVENTS’ reserve the right to terminate the client booking from that point without notice and the client will not be liable to receive any form of refund, compensation or other payment. Any damage caused by any of the participants of an activity or event will be charged directly to the person who made the booking with CORKSCREW EVENTS. This will include any intentional damage, or damage arising from unreasonable behaviour to suppliers' equipment, machinery, furnishings and public areas within the facilities booked by the client. The management of CORKSCREW EVENTS’ suppliers have the right to refuse ongoing services or entry to their premises to any individual whose behaviour is in their sole opinion inappropriate. CORKSCREW EVENTS cannot accept liability for the behaviour of others attending the same venue, activity or accommodation, or if any event is cancelled due to other parties’ actions. Breach of any Laws could lead to prosecution and is not tolerated by any member of CORKSCREW EVENTS.
COMPLAINTS:
Any complaints should be directed to the third party venue, activity or accommodation being used in the first instance. If this is not possible then the client should contact CORKSCREW EVENTS in writing within 7 days of the date of the event in order for CORKSCREW EVENTS to investigate / rectify the problem. Should the problem be related to accommodation, details should be passed immediately to CORKSCREW EVENTS by telephone. If the client continues to be dissatisfied and wishes to complain formally, this must be in writing and sent to the CORKSCREW EVENTS within seven days of the client return date. As long as the above conditions have been observed, the matter will be investigated and a reply will be sent to the client within 4 weeks of receipt of the complaint. If compensation is deemed to be appropriate by CORKSCREW EVENTS this will be limited only to the cost of the particular element of the package where the problem has arisen. Compensation arrangements do not apply to circumstances beyond our control.
